First you said 11 days ago. Now you say 2 weeks ago. Now you also add that you had queen cells when you split. With that info, YES, it's a swarm. Collect it at your earliest opportunity and get it into another hive.

My guess is, If they have an upper entrance, it's a beard.

If no upper entrance, it's a swarm.

PS. As stated, it's just a guess.

It is called burr comb and does no harm, but does no good either, so should be avoided if easily done.

Just center all frames tightly in the center of the box, leaving any space to the outside.

I would first pick up each drone larva and inspect for vorroa mites. Then I would scrape the burr comb off.

You don't say how many dead bees there were. If less than a quart, they probably had too few bees to produce enough heat and froze. DO NOT throw away the frames with dead bees. Shake out the dead as best as you can and put them back in the hive. The new bees will clean everything up and use those fr...

On the same note, show me where a beekeeper has been charged for retrieving a swarm in NC. As stated before, it is an understood rule or law that has been passed down and accepted for hundreds of years.

Unless you have been told to stay out, verbally, with signs, with fences, or however, you are not trespassing. Once you have been told or signaled to stay out, only then can you be charged with trespassing. If that were the case, you couldn't walk up to a house and ring the doorbell without breaking...

I would treat in the next 30 days with OAV, then check and treat just after harvest.

First, did you check to be sure the queens were still laying after the treatment?

Second, did you do a mite count afterward to see how effective the treatment was?

It sounds as if they went queenless and/or the treatment didn't sufficiently lower the mite count.
