NC Hive Law restriction

The NC General Assembly followed through with restricting cities and counties from regulating beekeepers with five or fewer hives.

I see where the bill was introduced in the Senate, but I don't see any House action or that the bill was ever voted on and passed for the Governor's consideration. Am I missing something?

I think the AP may have gotten ahead of itself. I've been searching the NC Legislature website with no success until today. Yesterday, September 22, 2015, H44 was sent to the Governor. It contains a new NCGS §106-645. Limitations on local government regulation of hives.

The law now before the Governor prohibits COUNTIES from adopting or continuing in effect any ordinance or resolution that prohibits the owning or possessing five or fewer hives.

The law now before the Governor permits (but does not require) CITIES to adopt ordinances regulating hives. IF a city adopts an ordinance, it must comply the 4 requirements listed--
1--it SHALL permit up to 5 hives on a single parcel within the land use planning
jurisdiction of the city

2--it SHALL require that hives be placed at ground level or securely attached to an anchor
or stand--the city MAY permit the anchor or stand to be permanently attached to
a roof surface

3--any ordinance MAY include regulation of placement of the hive on the parcel, including
setbacks from the property line and from other hives

4--any ordinance MAY require removal of the hive if the owner no longer maintains the hive
or if removal is necessary to protect the health, safety, and welfare of the public.

If signed into law or allowed to become law, this is a far cry from S225.

The Governor signed the House Bill on September 23, 2015.

Wow, I would have figured there was a limit on the amount of hives you could have a property so you couldn't have more than what would fit on your property
not that you needed 5 or more... :shock:
